Warranty
One Year Full Warranty Aqua-Life Water Systems, Inc. warrants each reverse osmosis unit and water softener to be free from defects in materials and workmanship under normal use within the operating conditions listed below. Upon proof of purchase and return to factory, Aqua-Life Water Systems, Inc. will, on units found defective, repair or replace same. Buyer's sole and exclusive remedy against Aqua-Life Water Systems, Inc. shall be repair or replacement of the defective product. Remedy for incidental or consequential are expressly excluded. The filter cartridges are not covered in the warranty. This warranty is valid to the original owner at original installation site. Buyer pays only freight and local labor charges starting after one year full warranty.
TERMS AND PROVISIONS
1. This Order shall become binding upon the parties hereto upon the acceptance of this Order by the Company; provided, however, that if the Customer is to finance the purchase of the item(s) covered by this Order, this Order may be canceled by customer within two business days after the date of rejection of such financing, by giving written notice of cancellation to the Company within such two-day period. The Company shall have a period of ten business days after the date of this Order within which to accept this Order,and this Order may not be revoked by Customer prior to the expiration of such ten-day period, except as otherwise provided herein.
2. The company may cancel and terminate any acceptance of this Order, or any contract relating thereto, if the Company determines that it cannot install the iterm(s) covered hereby.
3. The Company's sole obligation with respect to any defect in the item(s) covered hereby or in the installation of such item(s) is limited to the repair or replacement of the defective item(s)if covered by the warranty from the manufacturer (as the company may choose) or the correction of any defect in installation such obligation of the Company is contingent upon proper use of the item(s) or by reason of the removal of such item(s) are modified misused, neglected or tampered with by customer or third parties in no event shall the Company be responsible for any change to Customer's property by reason of the installation or use of the item(s) or by reason of the removal of such item(s) upon the breach of termination of this transaction, unless the Company was grossly negligent in the installation of the item(s) Customer hereby expressly agrees and acknowledges that the foregoing obligations of the Company contained in the paragraph 3 are in lieu of any and all other warranties, obligations, or repressentations of any kind whatsoever either expressed or implied, including without limitation any implied warranty of merchantability or fitness for a particular purpose in respect to the item(s) or in the installation thereof, except for those specially reserved to Customer under this paragraph3.
4. Customer will not misuse, move or alter the item(s) coverd hereby, nor deface or tamper with the Company's name-tag thereon Customer shall be responsible for the day-to-day care and maintenance of such items. All of the item(s) shall be surrendered to the Company upon the termination of the transaction contemplated hereby, in as good condition as when installed, reasonable wear and tear excepted (except in the case of a purchase of such items where all of the purchase price have been paid.) Upon termination(except in the case of a purchase of such items where all of the purchase price have been paid) or Customer's prior default in regard to any of Customer's obligations hereunder or under any other document which Customer may execute in connection with this transaction, The Company may enter the premises where any such item is located and remover and take possession of such item without process of law and without process of law and without liability for trespass or other damage whatsoever. The Company may also enter the premised to make any repair. A retaking of any such item under any circumtance shall not be deemed a waiver of any other right or remedy which the Company may have against Customer. All such items are personal property. and shall not be deemed affixed to or a part of the real estate. All rented items shall remain the exclusive property of the Company.
5. Customer shall not move any of the items covered hereby to any other location without the prior written consent of the Company. Customer shall not assign this Order of the agreement contemplated hereby, and will not sell, mortgage, encumber, lease or part with possession of any such items, nor do or permit to be done anything which results or may result in paying a lien, encumbrance or other assessment upon any such items. except if Customer has purchased such items and has fully paid for it. Customer shall bear the risk of loss or damage to any such items by fire or other casualty, as well as any other loss or damage not resulting from the company's gross negligence. Customer agrees to indemnify and hold harmless the Company from and against any claim, liability, losses, injury or costs (including reasonable attorney's fees) resulting from or caused by the failure of the Customer to comply with any provision hereof, or by negligence or carelessness on the part of Customer's household, employees of invites.
6. In the case to the rental of any item covered herey each party may terminate this agreement 30 days after written notice of temmination is delivered to the other party, unless otherwise terminated. On default by Customer, the Company may, immediately terminate this Agreement without notice, the entire amount contracted for shall become immediately due and payable.
7. After 12 month of rental of the items coverd hereby, the Company will give the Customer a credit for the installation charge paid by the Customer to the Company. This Credit shall only be applied to the rentals for the 13th and 14th month, and the amount cannot be paid to the Customer.
8. The Customer may pay any outstanding balances or monthly rents on a credit card accepted by th Company.
9. The Customer acknowledges that any delinquent payments are serious problems to the Company, and the Company shall have the rights to report any delinquent accounts to various credit information services, such as TRW, Equifax, or Experian, such a report to credit information services may have varying consequences to the credit rating of the customer. The Customer hereby authorizes Company to charge any delinquent payments to the Customer's credit card listed on the front page of this Form, at the sole discretion of the Company, if the Company determines the account is delinquent.
10. The Customer shall be responsible for a reasonable and customary installation fee when Customer cnacels a lease of items covered hereby prior to the completion of the lease term.
11. The Uniform Plumbing Code calls for water to be delivered from the water district to homes for domestic use at between 50 to 70 PSI (pounds per square inch). Supply lines as well as appliances are designed to withstand up to 80 PSI Accordingly, if a water pressure regulator installed on your domestic incoming water line fails and pressure exceeds 80 PSI the Company is not responsible for any water damage. In other words, the customer is responsible for household water damage even due to leaking from the water filtration system if a set pressure in your residence increases over 80 PSI.
